confused about what i can and cant transmit on as a tech — Part 97 stuff

ok so i passed my technician exam like two months ago and ive been pretty cautious about actually getting on the air because honestly the rules are kind of confusing to me still. like i understand the basic band privileges but theres stuff in Part 97 that i keep reading and then rereading and i still dont fully get it.

specifically im confused about third party communications — like can i just let my non-ham friend talk into my radio? i thought there was something about that being allowed in certain situations but then i also read something about third party agreements with other countries and now im more confused than when i started. also whats the deal with music, i saw someone mention you cant transmit music but what about like if theres background noise or a radio on nearby, does that count? probably overthinking this but i dont want to get a notice of apparent liability or whatever its called before i even really get started lol

yeah the third party thing trips up a lot of new hams. basically your friend can talk through your radio as long as you're the control operator and you're present and responsible for what gets transmitted — you cant just hand someone the mic and walk away. the country thing is a separate issue, it means if youre trying to pass a message to a ham in say Brazil or wherever, there needs to be a formal third party agreement between the US and that country or you technically cant do it. most major countries have agreements, you can find the list on the ARRL site.

the music thing — yeah you just cant broadcast music as content, like playing songs intentionally. incidental background noise generally isnt gonna get you in trouble, the FCC isnt sitting there with a stopwatch waiting for someone to sneeze on the air. use some common sense and youll be fine. the rules sound scarier than they are in practice, most hams never hear from the FCC in their entire lifetime.

im pretty new too so take this with a grain of salt but i spent like an entire weekend going through Part 97 when i was studying and the way it finally clicked for me was thinking of it as — you as the licensee are always responsible, period. whatever comes out of your radio is on you. so if your friend says something dumb or prohibited, thats your problem not theirs. that mental model made a lot of the rules make more sense to me anyway. the third party agreement stuff is real but honestly unless youre doing like formal message handling to certain countries you probably wont run into it for a while
