Internet linking regulations - Third party traffic restrictions?

Working on a RemoteTx setup to control my home station while traveling for work. The RemoteTx system uses a Raspberry Pi at the station connected via ethernet to the radio over USB. My question is about third party traffic when operating remotely from different countries.

ARRL changed DXCC rules in 2015 to explicitly recognize remote operating, but I'm unclear on the regulatory aspects. If I'm physically in Canada but operating my US station remotely, which country's third party traffic agreements apply?

I've read conflicting information and want to make sure I'm operating legally, especially since remote systems now give instant access to stations all over the globe.

From my understanding, you'd need to follow the more restrictive of the two countries' rules. I'd suggest contacting ARRL's regulatory department for a definitive answer.

I ran into this exact scenario last year operating my Texas station from Germany. After consulting with an ARRL volunteer counsel, the consensus was that third party traffic restrictions of BOTH countries apply - you're bound by whichever is more restrictive. So US-Germany allows third party traffic, but if you were in a country that prohibits it, you couldn't handle third party traffic even through your US station.

Just remember that some remote services like RemoteHamRadio explicitly state "If you do not hold a U.S. issued FCC license, you can obtain one" - they're assuming you have the proper license for the station location. The regulatory burden is on you as the control operator to ensure compliance with both jurisdictions. When in doubt, stick to CW and phone contacts without third party content.
